1. General

  • You are advice to read and understand these terms and conditions governing the http:// GreenHeart.penang.cc otherwise please do not use this site. By accessing this site, you agree to accept, without limitation or criterion all of these terms and conditions of use.

2. Site Availability

  • This site is accessible worldwide to anyone with internet access. However, this site may not be continuously available due to whatsoever reasons or any unforeseen circumstances which are outside and beyond our control.

3. Use of http://GreenHeart.penang.cc

  • You may only use this site to make genuine and valid bookings or purchases. You may not use this site to make any fraudulent, false and exploratory booking. You will be financially liable for all uses of this site. You will be responsible to keep your passwords, login and account information confidentially.

4. Information Accuracy

  • We reserve the right to revise any fares, tour itineraries, hotel pick-up and ferry schedules at any time and from time to time without prior notice.

5. Tour fare

  • The tour fares of tour itineraries are category into adult, child and infant determined by date of birth. An adult is 12years old + 1days & above, whereas a child is 3years old to 12years old and an infant is 3years old – 1days & below.

6. Tour itinerary

  • The tour itinerary is fixed on a combined tour basis. However, we reserve the right to change or cancel any portion of the itinerary without the risk of liability due to safety reasons or unforeseen circumstances.

7. Booking confirmation

  • The booking of seats for tour services is only confirmed after full fares payable in Ringgit Malaysia (RM) is made and after we issue you a booking number and tour e-voucher.
  • A confirmed booking is only valid for travel on departure date and travelers named specifically in your booking.

8. Booking changes

  • Once a booking number has been issued, all changes must be made on this site at least 72 hours before your tour departure date otherwise cancellation charges will be imposed.
  • There is an administration charge of RM 50.00 each time for changes made.

9. Surcharge

  • A surcharge of 25% on tariff rate will be levied for postponement of your tour or make changes less than 72 hours but more than 24 hours prior to departure.

10. Cancellation Charges

  • No refund for no-show or cancellation of internet booking less than 24 hours prior to departure. A cancellation of 25% on tariff rate is charged for internet booking cancelled less than 72 hours but more than 24 hours prior to departure.

11. Refund

  • An administration fee of 5% on the amount to be refunded or a minimum of RM 50 whichever is higher is charged on a refund. The refund will be made in Ringgit Malaysia (RM) and in the form of a credit entry to your credit card account only.

12. Hotel Pick-up

  • You need to be at the hotel lobby at least 5minutes before the scheduled pick-up point and time otherwise our coach or van will leave you behind for next pick-up point without the risk of liability.

13. Check-in and boarding

  • You need to check-in for boarding at least 15 minutes before scheduled departure time otherwise our ferry will leave you behind without the risk of liability.

14. Right to Refuse

  • We reserve the right to refuse you from the tour for reasons of safety or if we determine that:
    i. Such action is necessary for reasons of safety or security;
    ii. The payment of your fare is fraudulent;
    ii. The booking has been done fraudulently or unlawfully or has been purchased form a person not authorized by us;
    iv. The credit card by which you paid for the fare has been reported lost or stolen;
    v. The tour voucher is counterfeit or fraudulently obtained;
    vi. The tour voucher has altered by anyone other than us or has been mutilated;
    vii. Travel without a companion of at least 18years old if you are below age of 12 or require special assistance.
    viii. Suffering from infectious, contagious or chronic diseases;
    ix. bPregnancy 28 weeks and above.

15. No Seat

  • There is a chance a seat may not be available for you even if your booking is confirmed due to common practice in the travel industry of overbooking.
  • In the event of such unavailability of seat, we shall at our option; either refund full value of amount you paid or you chooses to travel at next day.

16. Things to bring

  • You are responsible for bringing along your towel and swim wears for snorkeling and diving, and cash for drinks or optional activities for your tour. Do not bring along not required personal items for your tour or leave behind your personal items unattended during your tour. The risk of damage or lost of personal belongings remain with you.

17. Tour transport

  • We reserve the right to determine the type of ferry, coach, van or transport to be used on sharing basis.

18. Weather conditions

  • The weather, sea conditions and water visibility is outside and beyond our control.

19. Non-used activity

  • The activity in tour services that is not been used will not be refunded.

20. Other charges

  • The entrance fees, surcharges, single occupancy charge, miscellaneous or incidental charge are excluded unless otherwise specified.

21. C-Card license

  • You are responsible for obtaining and must make available your scuba diving license for verification as required at the time of check-in.

22. Snorkeling and diving safety

• You need to be physically fit and free from breathing and heart illness.
  • No alcohol and medication should be consumed prior to snorkeling and diving, and wear snorkeling vest to reduce the risk of over exposure to the sun and help to reduce dehydration.

23. Travel insurance

  • It is strongly recommended that you must buy insurance for your travel needs.
  • Our group personal accident insurance below 75 years old is only covered up to RM 20,000.00 for loss of life or permanent disability and RM 1,000.00 for medical expenses.

24. Personal information

  • You are legally required to declare your full name and passport number for passenger declaration and insurance coverage.

25. Seating

  • We operate a single class and free seating policy.

26. Limited liability

• In the event if the tour is forced to be cancelled due to severe weather or sea condition, failure of machinery and mother nature, we shall be liable up to the value of tour services only and thereof after we shall have no further liability to you.
  • We shall be exempted from all liability caused directly or indirectly by events beyond our control which included, but not limited to pre-existing illness, third party negligence, war, civil disturbances, severe weather, failure of machinery, acts of government and mother nature.

27. Environment conservation

  • Collection of coral and aquatic life from the marine park, and flora and fauna from the national park is strictly not allowed. It is the joint responsibilities to conserve and protect your environment.

28. Liability disclaimer

  • The content and information found on http://GreenHeart.penang.cc site is provided, without warranty of accuracy, timeliness, currency and completeness, including without limitation any warranty concerning the information relating to rates, itineraries, pick-up, set lunch, inside package and seat availability provided through or in connection with http:// GreenHeart.penang.cc site and any implied warranties of merchantability, fitness for a particular purposes or non-infringement.
  • In no event shall Langkawi Saga nor its agents, affiliates, representative or preferred partners be liable for any direct, indirect, punitive, incidental or consequential damages whatsoever arising out from use or inability to use the content even if Langkawi Saga has been informed of the possibility of such damages.
  • This disclaimer of liability applies to any damages or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication-line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

29. Modification and waiver

  • None of our agents, employees or representatives has the authority to alter, modify or waive any provisions of these Terms & Conditions.
